Marine and Coastal Access Act 2009 (MCAA 2009)

LICENSABLE ACTIVITY, LEGALLY COVERED

In England the Marine and Coastal Access Act 2009 (MCAA 2009) establishes a requirement for works below Mean High Water Springs to be licensed by the Marine Management Organisation (MMO).

Undertaking a ‘licensable activity’ without a marine licence (or in breach of its conditions) can result in an unlimited fine or a custodial sentence of up to 2 years (for the most serious offences).

SEVEN CATEGORIES OF ACTIVITY THAT MAY NEED A MARINA LICENCE

  • Construction, including maintenance and alterations to existing assets
  • Dredging
  • Deposit of any substance or object
  • Removal of any substance or object
  • Incineration of any substance or object
  • Scuttling (sinking) of any vessel or floating container
  • Use of explosives
  • Sampling plans and sediment analysis delivery.

In parallel, some projects also require Environment Agency Permits or Harbour Works Consents, with Marina Projects best placed to offer advice on requirements on a project-by-project basis.
