LICENSABLE ACTIVITY, LEGALLY COVERED

In England the Marine and Coastal Access Act 2009 (MCAA 2009) establishes a requirement for works below Mean High Water Springs to be licensed by the Marine Management Organisation (MMO).

Undertaking a ‘licensable activity’ without a marine licence (or in breach of its conditions) can result in an unlimited fine or a custodial sentence of up to 2 years (for the most serious offences).

Construction, including maintenance and alterations to existing assets
Dredging
Deposit of any substance or object
Removal of any substance or object
Incineration of any substance or object
Scuttling (sinking) of any vessel or floating container
